How to Enter. NO PURCHASE IS NECESSARY. PURCHASING YOUR BOOK WILL NOT INCREASE YOUR CHANCES OF WINNING. The “Dog Days of Summer” Pet Photo Book Contest begins June 21, 2009 at 12:01 AM Pacific Standard Time (PST) and ends September 21, 2009 at 12:00 Midnight PST ("Submission Period."). All entries must be submitted online. No other method of entry will be accepted.

To enter the contest, go to www.bapit.com/s-19-download.aspx and download the free photo book software. You must use the BAP!t photo book software to create your book. When you have finished designing your book, hit the ‘send to BAP!t’ button in the software. Your book will be sent to BAP!t and you will be connected to the shopping cart for checkout.

If you are not purchasing your book, you must still go through the complete checkout process. Use the code (ENTRYONLY), your book will not be printed or shipped to you and you will not be charged.

If you are purchasing your book, use the code (DOGDAYS) at checkout, you will receive a 10% discount on your book purchase and 25% of the sale price will be donated to a charity pool and dispersed equally to animal-welfare charities. See our charity list.

Any book that is submitted without one of the two codes above will not be entered in the Contest.

Who is Eligible? The Dog Days of Summer Contest is open to all legal residents of the United States who are over the age of 18 when the Contest begins. Employees of Bark Avenue Press, consultants and affiliates who have participated in the administration of this Contest and their immediate families (parents, spouses, children, siblings and their spouses) are not eligible. This Contest is governed by the laws of the United States and is subject to all applicable federal, state, and local laws and regulations. This Contest is void where prohibited by law.

Photo Book Submission Requirements.

Warranties and Indemnification. You warrant that your Submission does not infringe any third party’s rights, and you have obtained any necessary permissions from any third party to submit the entry. You additionally, and specifically, warrant that your entry was not copied or otherwise plagiarized from another source and it does not include photos or content that violates a contract of third party rights; a merchandising agreement; or any other contractual relationship.

You agree to indemnify Bark Avenue Press against any and all claims from any third party for any use by Bark Avenue Press, its agents, successors or representatives of Photo Book entries.

Judging. Entries will be judged by a panel of judges on the basis of creativity, content, layout and design, and overall impression. All judging is at the complete discretion of the judging panel and all decisions of the judging panel are final.

Prizes. The prizes for the Dog Days of Summer Contest will be as follows:

All cash prizes will be awarded in the form of a check. If you are unable to accept a prize for any reason, Bark Avenue Press will have no further obligation to you and reserves the right to select another winner. You assume all risk related to prizes, including but not limited to any and all taxes. Prizes will be sent via U.S. mail. Bark Avenue Press is not responsible for lost prizes.

Animal Welfare Charities. Bark Avenue Press has selected the following Animal Welfare Charities as recipients of your participation in the Dog Days of Summer Contest:

The top three Contest winners will each be able to choose the animal-welfare charity that will receive the donation equivalent to the winner’s cash prize of $1200, $600, and $300 for 1st, 2nd and 3rd place, respectively.

Purchase of book entries is not required for contest participation. However, in the event a Participant chooses to purchase the book he/she has entered, Bark Avenue Press will donate 25% of the sale price to the above listed animal-welfare charities. The sale price donation will be pooled and divided equally among the charities.

NOTE: All names, logos, trademarks and Web site content are the property of their respective owners.

Winners Notification. Winners will be notified by email. Bark Avenue Press will use the email address provided during the Contest submission process. Winners will be required to execute and return a Prize Acceptance Package including an Affidavit of Eligibility; a Declaration of Authenticity; a Release of Liability; and a Name and Book Use Authorization, within 7 days of the notification. Failure to respond to the notification or comply with these rules will result in the forfeiture of the prize and Bark Avenue Press will select an alternate winner.

Winners grant Bark Avenue Press the right to use and publish their name and state of residence and the prize won on its Web site, in print, or any other media in connection with the Contest. Winners also grant Bark Avenue Press the right to publish and display their winning book and any of its content on its Web site, at trade shows, in print or any other media in connection with advertising and Contest of the Contest.

Conditions. As a condition of participating in this Contest, participant agrees:

Limitations on Liability. Bark Avenue Press is not responsible for any incorrect or inaccurate information, whether caused by Web site users, equipment, programming, printing or technical malfunction, or by human error, that may occur in relation to the submission of photo book entry. Bark Avenue Press is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Contest.
